Crypto Advocacy Groups Challenge Illinois Digital Asset Tax in Court

Crypto Advocacy Groups Push for Swift Court Ruling on Illinois Digital Asset Tax

Sangamon County, IL — In a significant move for the cryptocurrency community, the Crypto Council for Innovation (CCI) and the Blockchain Association (BA) have joined forces with the Digital Chamber and other organizations to expedite legal proceedings regarding Illinois’s controversial digital-asset tax, set to take effect in 2027.

In a filing submitted to the Circuit Court of Sangamon County on Tuesday, these advocacy groups requested an expedited schedule for summary judgment, aiming to resolve the legality of the tax as quickly as possible. The filing references a lawsuit against Illinois state officials, alongside a separate suit initiated by the Digital Chamber and the Illinois Blockchain Association.

“While pausing enforcement of the Digital Asset Tax Act protects Illinois consumers and businesses from this onerous and legally flawed tax until July 1, it remains imperative that the merits are determined as soon as possible,” stated CCI CEO Ji Kim.

Earlier this month, Illinois officials agreed to delay the implementation of the 0.2% crypto tax law from January 1 to July 1, 2027. This decision was influenced by claims that the tax had been “slipped into the state’s budget” without adequate debate or public input. Digital Chamber CEO Cody Carbone emphasized the organization’s commitment to legal action, asserting, “We will continue with proceedings until this tax is struck down for good.”

If the court approves the proposed expedited schedule, a ruling on the merits of the law could be reached as early as March, potentially shaping the future of digital asset taxation in Illinois.

Leadership Changes at Blockchain Association

In a separate but notable development, the Blockchain Association is undergoing a leadership transition. Summer Mersinger, who took the helm of the organization last year after her tenure at the U.S. Commodity Futures Trading Commission, is set to step down as CEO on Friday. Kristin Smith, the former CEO, will assume the role of interim head, while Mersinger is expected to remain involved until the end of 2026.

As the crypto landscape continues to evolve, both the legal challenges surrounding digital asset taxation and the leadership dynamics within advocacy organizations will be closely watched by stakeholders across the industry.
